Trump administration sues California for its sanctuary state legislation

Trump administration suing to block California laws protecting immigrants living illegally in the US

The Trump administration on Tuesday sued to block California laws that extend protections to people living in the US illegally, the most aggressive move yet in its push to force so-called sanctuary cities and states to cooperate with immigration authorities.

"The Department of Justice and the Trump administration are going to fight these unjust, unfair, and unconstitutional policies that have been imposed on you", Attorney General Sessions is expected to tell a gathering of California police officers Wednesday in Sacramento.

The legal battle pits U.S. Attorney General Jeff Sessions against California Attorney General Xavier Becerra.

A second law, Senate Bill 54, prevents state and local law enforcement from giving federal immigration officials information about when they intend to release an illegal immigrant from their custody.

Assembly Bill 450 prohibits private employers from voluntarily cooperating with federal immigration officials. The state wants a judge to certify that its laws are in compliance with federal immigration law.

The administration has lost in a lot of them, especially in its efforts to restrict immigration from a number of mostly Muslim countries.

The announcement comes after Oakland Mayor Libby Schaaf warned residents of an imminent raid by federal immigration agents last week that led to criticism by the ICE director saying the mayor tipped off criminals.

De Leon also described the lawsuit as a "racist and xenophobic attack", writing, "If Sessions is serious about cracking down on crime, he should stop fretting about CA and look in his own backyard". None of the groups favored the state law restricting cooperation with immigration officials, but only the California State Sheriffs' Association was actively opposed and some individual officials voiced support.

The nation's top cop will speak about "sanctuary jurisdiction" issues at an annual conference organized by California Peace Officers' Association, according to the U.S. Department of Justice. Many state and local officials in California say the administration's stepped-up deportation efforts are making communities less safe and undermining local economies.

"At a time of unprecedented political turmoil, Jeff Sessions has come to California to further divide and polarize America", Brown said.

The issue of illegal immigrants has become increasingly heated since Donald Trump became president previous year and signaled that he planned to target a wider swath of people for deportation. The DOJ does not plan to argue that Section 1373 requires local law enforcement to hold people exclusively based on ICE requests ― known as "detainers" ― which many jurisdictions have rejected based on cost and constitutionality concerns. This review applies only to facilities with civil immigration detainees. "It's a punch back to the lawlessness that's rampant in the state of California. I appreciate the efforts of Attorney General Jeff Sessions and the Department of Justice to uphold the rule of law and protect American communities".

In a statement released about the new lawsuit, Homeland Security Secretary Kirstjen Nielsen said: "California has chosen to purposefully contradict the will and responsibility of the Congress to protect our homeland".
