MLAs disqualification: Truth prevails in the end, says Arvind Kejriwal

President gives assent to disqualification of 20 AAP MLAs

A central government notification on Sunday said that 20 AAP MLAs of Delhi Assembly had been disqualified, reported news agency PTI.

Reacting on President's approval Delhi Minister Gopal Rai said the party will approach the High Court and even the Supreme Court if need be.

The Election Commission had said that these MLAs, by occupying the post of parliamentary secretaries between March 13, 2015, and September 8, 2016, held an office of profit and were liable to be disqualified as legislators.

The AAP has made a decision to fight it out in the courts, where its principal line of argument will be that the MLAs did not hold offices of profit as Delhi High Court had set their appointments aside in 2016.

Otherwise we would have been nothing. Even though, the disqualification doesn't jeopardise the Arvind Kejriwal government, his party's MLAs in the assembly will come down to 45.

The BJP was quick to question if the AAP government had any "moral right" left after the EC's recommendation to the President.

Aam Aadmi Party will retain government in Delhi despite disqualification of 20 MLAs as it had won 67 seats and removing 20 will still keep them in majority.

The governor acted after the High Court of Meghalaya had on November 9 declared the appointment of parliamentary secretaries illegal based on a PIL filed by Sumer. Addressing a fathering in Najafgarh on Sunday, the CM said: "They are trying to harass us by all means".

Governor Ganga Prasad has sent a reminder to the Election Commission of India regarding disqualification of 17 Meghalaya parliamentary secretaries for holding the office of profit. In fact, Chief Election Commissioner Achal Kumar Joti had told journalists here last month that the Commission was examining the matter referred by the Meghalaya Governor on the High Court order.

Of these 21 MLAs, Rajouri Garden legislator Jarnail Singh had resigned from his seat before contesting the Assembly elections in Punjab.

Rai said the party members in all 70 constituencies will join the Confederation for All India Traders (CAIT) when traders observe a day long "Delhi trade bandh" on January 23 to lodge their protests against ongoing sealing of business establishments in the city.

This disqualification will lead to by-polls in Delhi. Rubbishing the AAP's claim that the disqualified MLAs were not given a hearing by the EC to present their case, Delhi Congress chief Ajay Maken alleged, "The delay was deliberate and due to a deal between the BJP and the AAP, the EC knowingly did so".
