ConCourt to rule on Zuma impeachment case on Friday

Chief Justice Mogoeng Mogoeng disagreed with the judgment, describing it as "a textbook case of judicial overreach".

"We made a wise decision by calling for the National Assembly to start a process of impeaching Zuma so I think the court has given us a guideline to say go back and develop rules as soon as possible so let's hope that the so-called new ANC will support the opposition parties and make sure that we produce these rules and regulations as soon as possible", Holomisa said.

Zuma, 75, has been accused of using $15 million in state funds to upgrade his home.

Together, these developments will give rise to new calls to strip Zuma of his position before South Africa's next presidential election in 2019, in which he can not participate, promising more trouble ahead for the lame-duck president. Now that the ruling party's top seat is no longer his, but Cyril Ramaphosa's, Zuma may not have the same protection he once had.

"Properly interpreted, Section 89 implicitly imposes an obligation on the assembly to make rules specially tailored for the removal of the president from office".

"This just adds to the existing pressures that Jacob Zuma is already laboring under, " Daniel Silke, director of Cape Town-based Political Futures Consultancy said by phone in Cape Town.

The court was hearing a case brought by opposition groups who wanted parliament to be compelled to begin impeachment.

"The assembly must put in place a mechanism that could be used for the removal of the president from office".

Zuma, an earthy politician with scant formal education who spent a decade in prison with Nelson Mandela for fighting apartheid, has faced numerous corruption allegations throughout his presidency.

In March a year ago, the Constitutional Court had found President Zuma guilty of failing to uphold and respect the Constitution by refusing to pay back the money.

The ANC will study the judgment and discuss its implications when its National Executive Committee meets on January 10, it said in an emailed statement.

OUTA said that once again, the Courts have been called to force elected officials to do their duty.

The court also disagreed with Parliament's contention that it had held Zuma accountable.
