Democrats on Voter Fraud Panel Join Those Criticizing It

Exclusive – Kobach: It Appears That Out-of-State Voters Changed the Outcome of the New Hampshire US Senate Race

These are state-by-state responses to a request for detailed voter data from President Donald Trump's Presidential Advisory Commission on Election Integrity, which is investigating voter fraud. For two decades, he's been the driving force behind suppressive policies like strict voter ID laws. Various constitutional provisions certainly implya right to vote-but the Supreme Court has interpreted these stingily.

The Kansas secretary of state told reporters after the meeting that such claims are "bizarre" because they assume the commission can perform a "Jedi mind trick" on state legislatures to make them adopt its recommendations.

The story focuses on a voter fraud commission held in New Hampshire Tuesday, led by Kansas Secretary of State Kris Kobach. Kobach argues that the fact that many of these same-day voters still don't have New Hampshire IDs ten months later could be a sign of fraudulent voting. He said "appears" might have been the wrong word.

New Hampshire Secretary of State Bill Gardner, who sits on the commission, told the Union Leader that the data didn't amount to proof of fraud and has suggested that the out-of-state licenses do have other possible explanations.

Out of state voters may have changed the outcome of elections in New Hampshire, where 6,540 people were recently found to have registered on the same day using out-of-state drivers licenses.

When the Presidential Advisory Commission on Election Integrity was established four months ago, Kobach asked authorities in every USA state to turn over complete records of everyone who voted in those jurisdictions, with full personal details - a demand that was immediately rejected by the states, nearly unanimously.Complaints and concerns that states used to justify their refusal to cooperate with Kobach's investigators included the threat of computer hacks, and equally widespread concerns about the federal government amassing too much personal information in one database.

But Gardner pointed out that New Hampshire law allows another category - those domiciled in the state - to legally vote.

"The specter of extreme political partisanship already threatens our ability to reach a consensus", Gardner said. "After my own participation as a member, I'm confident that all members of the commission are committed to uncovering the truth about election integrity". "We are not having voter fraud", said Jane Byrnes, organizer.

The testimony marked a departure for the commission, which was formed to look into fraud and barriers to voting, but which heard that a potentially greater threat to confidence in American elections is the chance for enemy actors to meddle.

A spokesman for the commission didn't immediately respond to a request for comment.

Trump trounced Clinton in the all-important Electoral College vote, 306 to 232, to win the presidency.

In a statement, the Heritage Foundation, a conservative think tank, said the employee who wrote the email is von Spakovsky, a former member of the Federal Election Commission.

"This commission has no meaningful bipartisan credentials", said Trevor Potter, the fund's president, "and its goal is based on false charges of voter fraud that have already been repeatedly disproven".

"If they are picking mainstream Republican officials and/or academics to man this commission it will be an abject failure because there aren't any that know anything about this or who have paid any attention to this issue over the years", the email says.

As the home of the "first in the nation" primary, New Hampshire plays a special role in our democracy.

The Presidential Advisory Commission on Election Integrity has spurred controversy since it was established in May. "What I'm saying is that the arguments Kobach presents about fraud in New Hampshire - and I recognize the significance of what I'm about to write - should have been too far afield even for Breitbart", writes Washington Post's Phillip Bump. Back in June, Kobach offered a similar explanation in a lawsuit with the ACLU where he was sanctioned and fined $1,000 for misleading the court about a document he brought to a meeting with Trump, dismissing his wrongdoing as another "misunderstanding".
