Little Charlie's parents drop case against state to keep son alive

Gard's parents told the court Tuesday that their "last wish" is for the hospital to allow their terminally ill son to die at home.

But Katie Gollop, the lawyer representing the hospital, said Great Ormond Street would fulfil the wishes of Charlie's parents "if practical" and that his life support could not be provided at home.

Charlie suffers from a rare genetic condition called mitochondrial DNA depletion syndrome that causes progressive muscle weakness and has left him with brain damage and unable to breathe without a ventilator.

Yesterday Connie Yates and Chris Gard abandoned their legal action to take 11-month-old Charlie to the United States for treatment.

Today barrister Grant Armstrong, who represents the husband and wife, told Mr Justice Francis that GOSH were placing obstacles in their way by denying the parents' wish to bring the tot home.

The case drew worldwide attention after Charlie's parents received support from the pope, Trump and some members of the U.S. Congress.

Outside court on Monday, Chris Gard said the couple wanted to spend their final hours with their son.

So far as GOSH is aware, invasive ventilation is only provided in a hospital setting.

"It is in Charlie's best interests, and everybody's, that the risk of a precipitate, distressing or disordered death is removed so that he may be assured of a peaceful and dignified passing". The parents were given the test results from Charlie's most recent scans on Friday. Although Charlie is now assisted by only one nurse, and medically stable, Mr Justice Francis said the trauma of transfer and something going wrong was "unthinkable" and that the only options for Charlie is to pass away at Great Ormond Street or a hospice.

Charlie - who suffers from a rare genetic condition causing progressive muscle weakness and brain damage - would turn a year old on August 4, but his parents believe he "unfortunately won't make his first birthday".

"If the (experimental) treatment had been tried in time, there would have been some possibility of having an impact on this disease", Enrico Bertini told journalists.

"If we are concerned with the language of rights, it is, of course, children who have rights; any rights that parents have exist only to protect their children's rights", Kennedy concluded.

The couple said they had wanted to give Charlie a real chance of getting better and that a "whole lot of time has been wasted". Lawyers for Charlie's parents said they were willing to pay all costs and had other suitable family properties if needed.

"These are issues which cry out for settlement", Judge Nicholas Francis said.

English courts and the European Court of Human Rights agreed with the healing center.

He says delays in treating Charlie mean his condition is now so poor that treatment will not help.

But the couple had recently returned to court, saying they had new evidence and they asked Mr Justice Francis to change his mind.
